AUTHORIZATION AND ASSUMPTION OF RISK

I, the undersigned participant or the parent/legal guardian of the above-named minor participant (the “Participant”), hereby acknowledge and consent to participation in the Discover Fellowship Church Awana Grand Prix (hereafter “DFCGP”) program (the “Program”) conducted by the above-named Church. The Participant will take part in the specific DFCGP sport designated at the time of registration. In consideration of the privilege of participation in the Program, the undersigned individual states as follows:

I understand the nature of the Program. I understand that this Program is a nonprofit Christian sports ministry and that participation is voluntary and is not essential to completion of requirements of any program, school, government, or other agency. I further understand that the Program is conducted by the Church and its volunteers, staff, and parents of other participating children. I also understand that the Church is solely responsible for all aspects of the Program, including selection and supervision of all persons conducting and participating in the Program and that DFCGP is not responsible for the Program or selecting and supervising persons conducting or participating in the Program.

I understand the risks associated with participation in the Program. I further understand and agree that participation in athletic and other activities of the Program necessarily involves the risk of injury, illness, and even death from various causes, including but not limited to accidents, falls, strenuous and prolonged physical activity, dehydration, communicable and infectious diseases (such as influenza, MRSA, and COVID-19), myocarditis, cardiac arrest, concussion collision or dispute with other participants, exposure to biting insects that may carry disease, weather-related injuries, facility and equipment defects, and the lack of immediate availability of medical care or medical facilities, and negligence of coaches and referees (the “Risks”).

I (AND ON BEHALF OF MY CHILD, IF SIGNING AS PARENT/GUARDIAN) FULLY AND VOLUNTARILY ACCEPT AND ASSUME ALL SUCH RISKS AND ALL RESPONSIBILITY FOR LOSSES, COSTS, AND DAMAGES INCURRED AS A RESULT OF PARTICIPATION IN THE PROGRAM.

RELEASE OF LIABILITY – PARTICIPANT RIGHTS

For Adults: I hereby release, discharge, and covenant not to sue the Church, DFCGP, and their respective officers, directors, employees, volunteers, agents, insurers, and affiliates (collectively, the “Released Parties”) and each of them, of and from, and do discharge and waive, any and all claims, including negligence, demands, losses, damages, and liabilities that I may have or sustain, including attorney's fees and costs, with respect to any and all property damage, economic loss, medical expense, personal injury, and other injury or harm, and/or death, arising directly or indirectly from participation in activities with the Program, and any first aid, medical care or treatment provided to me in the event I am injured or become ill while participating in Program activities. The foregoing sentence shall apply without limitation to all claims, demands, losses, damages, and liabilities, including claims for negligence, arising directly or indirectly from participation in any activities with the Program.

For Minors: On behalf of myself and my child’s other parent and/or legal guardian, I hereby release, discharge, and covenant not to sue the Released Parties, and each of them, of and from, and do discharge and waive, any and all claims, including negligence, demands, losses, damages, and liabilities that my child may have or sustain, including attorney's fees and costs, with respect to any and all property damage, economic loss, medical expense, personal injury and other expense, injury or harm, and/or death, arising directly or indirectly from my child’s participation in activities with the Program, and any first aid, medical care or treatment provided to my child in the event my child is injured or becomes ill while participating in Program activities. The foregoing sentence shall apply without limitation to all claims, demands, losses, damages, and liabilities, including claims for negligence, arising directly or indirectly from participation in any activities with the Program.

RELEASE OF LIABILITY – PARENT/GUARDIAN RIGHTS

I hereby release, discharge, and covenant not to sue the Released Parties, and each of them, of and from, and do discharge and waive, any and all claims, including negligence, demands, losses, damages, and liabilities that I as the parent/guardian of my child may have or sustain, including attorney's fees and costs, with respect to any and all property damage, economic loss, medical expense, personal injury and other injury or harm, and/or death, arising directly or indirectly from my child’s participation in activities with the Program, including without limitation the Risks described above. The foregoing sentence shall apply without limitation to all claims, demands, losses, damages, and liabilities, including claims for negligence, arising directly or indirectly from participation in any activities with the Program.

INDEMNIFICATION

The covenants and undertakings of this Release are given for and shall be binding upon me and my child's (if applicable for minor Participant), family, heirs, estate, next of kin, executors, administrators, legal representatives, beneficiaries, successors and assigns. I AGREE TO INDEMNIFY, SAVE AND HOLD HARMLESS the Released Parties, and each of them, from and against any and all claims, demands, losses, damages, attorney's fees and costs, expenses, and liabilities made against or incurred by any of them, including those for indemnity, contribution or otherwise, arising from participation in the Program activities and the Risks, whether resulting from claims, actions or lawsuits asserted by me or by another person against the Released Parties, except to the extent prohibited by applicable law.

This Release of Liability shall be as broadly construed as allowed by law to include all claims and rights that the Participant and I as parent/guardian (if minor Participant), and that other family members may have. I am a legally responsible parent or guardian of my child (if applicable for minor Participant). If any provision of this Release of Liability is deemed invalid, the remaining provisions shall remain in full force and effect. This Release of Liability shall be binding on me, my family, heirs, next of kin, legal representatives, beneficiaries, successors and assigns. I acknowledge and consent that registration will allow DFCGP to obtain access to personal information regarding me and my minor Participant (if applicable). I agree that DFCGP may use such personal information in a manner consistent with DFCGP's Conditions of Use and Privacy as amended from time to time. I further understand that the current version of DFCGP's Conditions of Use and Privacy may be found at www.upward.org.

PARTICIPATION AND SAFETY

I understand that participation in the Program may involve strenuous and prolonged physical activity. I confirm that the Participant is healthy and able to safely participate in Program activities. I understand the Church may request health information or require a medical evaluation. The Church may, at its discretion, determine if participation is not appropriate based on safety concerns. I accept the Church’s authority to make such determinations in the best interest of all participants.

CONSENT TO MEDICAL TREATMENT

In the event of illness or injury and if I am not present to make medical decisions for my child (or if I am the Participant and unable to do so), I authorize the Church, its staff, and volunteers to arrange for and consent on my behalf to emergency medical or dental care and treatment, including tests and radiological exams, and surgery, transportation to a hospital or clinic for care and treatment, and to consent to medications for pain and other conditions as prescribed by medical personnel. I understand I am responsible for payment of any medical charges or expenses not covered by my insurance or the insurance applicable to my child (if minor Participant). My signature below indicates that all information provided in this form is true and accurate, and that I fully agree to all statements made on the form, including but not limited to the Authorization and Release of Liability, Medical Conditions, and Consent to Medical

Treatment. My signature also indicates that all legal guardians are aware and consensual with the participation of the above-named child (if minor Participant).

PHOTO AND RECORDING ACKNOWLEDGEMENT

I acknowledge that the Church and/or DFCGP may take photographs or film or digital recording of the Participant during Program activities. I hereby authorize the Church, DFCGP and their agents to take, use, display, publish, reproduce, and distribute any and all such images or recordings that include Participant and to create derivative works based upon all such photographs and recordings, including use in media releases, reports on the Program, marketing and promotional materials, newsletters, and websites, social media, and electronic communication.

MARKETING AND COMMUNICATION

By completing this registration, and by affixing your signature below, you acknowledge that you have read and that you understand these disclosures, and that you consent to receive promotional, informational, and marketing communications from DFCGP at the phone numbers and email addresses you provide even if you have registered those phone numbers on any state or national do-not-call lists. You understand that DFCGP may send you emails, text messages, and other electronic communications. These communications may by autodialed and may relate to current and future Upward Sports programs, leagues, events, resources, and opportunities available to you and your family. Such communications may be sent throughout the duration of the current Upward season and may continue thereafter unless and until you elect to opt out, unsubscribe, or otherwise withdraw your consent. Upward Sports will provide clear instructions within each communication to allow you to manage your preferences or discontinue receiving future messages at any time. Providing your consent is not a condition of registration, and consent is not a condition to purchase or use any products or services of DFCGP.

My signature confirms that I have read and understand this entire document and agree to its terms on behalf of myself and/or the above-named minor Participant. I also confirm that all information provided is accurate and that all legal guardians of the Participant (if minor Participant) have been made aware of minor’s participation in the Program.
